Federal law generally prohibits the copying of federal identification, including Military IDs. However, FFLGuard did receive an opinion from ATF Headquarters stating that the copying of federal IDs pursuant to accurate completion of a federal document is permissible.
There has yet to be a case where an FFL was prosecuted for copying a military ID pursuant to a legal transfer.
Although there is no federal requirement that copies of ID’s be kept by firearm dealers pursuant to a lawful transaction, it is generally considered the best practice for firearm dealers to do so.
