Violation Consequences
Violations of the federal firearms laws can have serious consequences for Federal Firearms Licensees. The Bureau of Alcohol, Tobacco, Firearms and Explosives may impose civil or criminal penalties on an FFL. They may even suspend or revoke the FFL’s license.
The ATF may require the FFL to take corrective action, such as implementing new recordkeeping and reporting procedures. They may also require additional training to employees. These requirements will require you to take away from valuable selling-time.
Criminal penalties for even minor violations of the federal firearms laws can mean:
1) Minor violations: Misdemeanor charge with a maximum penalty of one year in prison and/or a $100,000 fine.
2) Major violations: Felony charge with a maximum penalty of 10 years in prison and/or a $250,000 fine.
Civil penalties for violations of the federal firearms laws are separate from ATF penalties. They can include fines of up to $250,000 and/or the forfeiture of any products involved in the violation.
Is Revocation a possibility for you?
In addition to civil or criminal penalties, the ATF can suspend or revoke an FFL’s license. Activities that require a license cannot be completed. These activities include buying, selling, or transporting firearms. After revocation, you cannot reapply for a license for an undetermined period of time.
