What is a 03 FFL?

A Type 03 FFL (C&R License) deals with collectors of curio and relic firearms. This Federal Firearms License defines “curio or relic (C&R) firearms as those which are of special interest to collectors by reason of some quality other than is associated with firearms intended for sporting use or as offensive or defensive weapons” (Bureau of Alcohol, Tobacco, and Firearms).

What is a Curio or Relic Firearm?

The ATF sets specific criteria to classify firearms as C&R status. These include:

  • Firearms must be at least 50 years old and not a replica.
  • The firearm must be recognized as a curio or relic by a curator from a state or federal museum.
  • Firearms that are either rare or hold significant importance, where their value largely comes from being collectible rather than functional.

If there is uncertainty whether a firearm meets these criteria, it can be submitted to the ATF’s Firearms and Ammunition Technology Division (FATD) for formal evaluation.

Advantages and Disadvantages of a Type 03 FFL

Advantages

  1. You can engage in interstate commerce without additional hassles
  2. You can acquire up to 30 firearms at one time
  3. Ammunition can be shipped to your home

Disadvantages

  1. While many antique firearms qualify, NFA items under the National Firearms Act, such as full auto/machine guns or short-barreled rifles, are still subject to specific restrictions, even if they are over 50 years old.
  2. This firearm license is designed for collecting, not for running a gun-selling business. The FFL for a licensed firearms dealer is a Type 01 or Type 07 FFL, which carries a different set of responsibilities.

Type 03 FFL Legal Requirements

To obtain a Type 03 FFL, applicants must fill out the standard FFL application (ATF Form 7) as used for Type 01 and Type 02 licenses. This includes submitting fingerprint cards and undergoing a background check by the FFLC. Not all Type 03 FFL holders are responsible for the FFL transfer fee.

Unlike other FFL license types, the C&R FFL doesn’t require an on-site inspection. Applicants only need to complete Part B for personal information, whereas for a Type 01 FFL, all directors and responsible persons must complete it.

  • Be at least 21 years old
  • Be a US Citizen or legal permanent resident
  • Legally eligible to possess firearms and ammunition, with no felony convictions, controlled substance abuse, or psychiatric conditions that would disqualify ownership
  • Have a predetermined physical location for conducting your FFL activities
  • Have never violated the Gun Control Act or other firearms regulations
  • Accurately complete the FFL application and submit it to the United States Bureau of Alcohol Tobacco and Firearms (ATF)
  • Pay all related application fees ($30 application fee, $30 renewal fee for every three years)

State and local FFL requirements can vary based on your location. These typically include registering your business with state law enforcement and securing an additional license after receiving federal approval.

Most states also require permission from local zoning boards, particularly if you’re dealing with destructive devices or explosives. You may also face pre-licensing inspections from the local zoning board or fire marshal to ensure your business complies with local laws.

How to Apply: Download and complete the FFL application from the ATF website. Fill out and include the Responsible Person Form (Part B), crucial for your application’s review.

Mail in the completed application along with Part B to the designated Post Office Box listed on the form. The ATF then initiates a background check. Successful applicants will receive their Type 03 FFL for a Licensed Collector without needing an on-site inspection or interview.
